For private test requests, samples must be submitted with the proper submission form containing complete and accurate information. All payments must be received at the time of the request. Results will only be reported to the person submitting and paying for the sample to be tested (hereafter referred to as the Client).The lab will seek to provide results within three weeks. Results will be provided to the Client electronically and/or as a hard copy. 

The University strives to use reasonable care in identifying each sample upon receipt, processing the samples submitted to it for the tests selected on the submission form, and in reporting the results to the Client. Due to the nature of the service to be performed, however, neither the University nor the laboratory makes any representations, guarantees, or warranties, expressed or implied, as to the results reported by the laboratory. If errors are brought to the attention of the laboratory, it agrees to re-run the analysis on resubmitted samples at no additional charge to the Client. Client acknowledges and agrees that re-running the analysis is Client’s sole and only remedy in the event of any mistake or error and hereby waives and releases any and all claims against University, its employees and agents in any way relating to the test and report. The Client will defend, indemnify and hold harmless the University and its  employees and agents against any loss or damage, including attorney fees and related expenses incurred by them in connection with any threatened or actual claim, action, suit or proceeding based upon use of the results or related to this Agreement or the performance or any service contemplated by this Agreement.

These Terms and Conditions constitute a binding agreement between the Client and the University of Kentucky which shall be governed by the laws of the Commonwealth of Kentucky and any claim or action may only be filed in the Franklin Circuit Court under the Kentucky Contract Claims Act.
